Can Higher Ed let out a sigh of relief over the patent wars?

Not yet. Not quite yet according to Michael Feldstein. (Thank you, Michael!) We are so close. I’m letting out a teeny sigh myself. The US Patent & Trademark Office (USPTO) issued its “non-final action” on the Blackboard patent declaring all 44 of Blackboard’s claims as invalid.

All 44 claims.

Declared invalid.

Hope the non-final goes to FINAL soon.

Maybe on a Friday… Good things happen on Fridays.

  1. Hallelujah!! The USPTO has pulled its head out of its ass! Let’s hope this goes to FINAL soon. I don’t want to see D2L languish because of Blackboard. If Bb was so confident in their product, why do they feel the need to attack such a small competitor?!?
